Is marijuana legal in California?

Yes. Medical marijuana has been legal in California since 1996. Proposition 215, known as the “Compassionate Use Act,” made California the first state in the U.S. to allow marijuana used for medical treatment. This means that purchasing marijuana for patients with conditions qualified for medical use is permitted in the state.

In addition, the adult use of marijuana is legal in California thanks to the introduction of Proposition 64, also referred to as the Adult Use of Marijuana Act. Sales of cannabis and cannabis products for recreational use became officially legal on January 1, 2018. This means adults aged 21 and can now buy cannabis even without a medical marijuana identification card or a physician’s recommendation.
Can I smoke cannabis in public in California?

No. Cannabis may be legal in California, but the law does not permit a person to smoke or ingest cannabis or any other cannabis product when they’re in public places.

Marijuana consumption must occur in a private space, even if you have a medical license. On-site consumption is only allowed inside businesses holding a commercial consumption license.
Do I still need a medical card in California?

Per California law, a physician’s recommendation is all you need to purchase medical cannabis. Additionally, can buy and use recreational cannabis if you are 21 years old or above.

However, the Medical Marijuana Identification Card Program (MMICP) can be helpful in many ways, such as when you need to buy cannabis in amounts that exceed the limit for recreational use. Additionally, using a medical card means you won’t have to pay sales tax when purchasing marijuana.
Does California accept out-of-state medical cards?

No. California doesn’t have a dedicated reciprocity program with other states. This means patients with out-of-state medical marijuana identification cards (MMIC) cannot buy cannabis when they are in California beyond the amount entitled to all individuals 21 years and older.

However, they can apply for a California MMIC so they can legally buy from medical dispensaries. A California MMIC is valid in all California counties as it is a statewide ID and registry program.
Where is it safe to use marijuana in CA?
It may be legal to use and possess cannabis in California, but you cannot do so on federal lands such as national parks. Private residences are the primary place where it’s legal to consume cannabis in California. Additionally, cannabis consumption lounges (typically housed within dispensaries) provide a more public option.

How much marijuana am I allowed to buy?

According to the Compassionate Use Act of 1996, patients using medical marijuana can buy whatever amount they’re prescribed by a licensed physician.

Recreational use of cannabis, however, is different. Proposition 64 states that adults can carry only as much as 1-ounce of bud or flower legally. They can also only possess 8-grams of hash oil or dab.
Can I go to a dispensary without a card?

Yes, you can. It is legal to buy cannabis from a dispensary even when you don’t have a medical card.

If you need cannabis for treatment and intend buy more than the standard amount permitted for persons 21 and older in the state, you will need to get a medical marijuana card.
